Acknowledgment

This section explains the legal importance of the Terms and Conditions and what you're agreeing to when you use the app or service.

Here’s what it says, in simpler terms:

1.     These Terms Are a Legal Agreement
These Terms and Conditions are a binding contract between you (the user) and the company (hoocup.fun). They explain your rights and responsibilities when using the app or service.

2.     You Must Accept These Terms to Use the Service
By simply accessing or using the service (like opening the app, registering, or browsing), you are agreeing to these Terms.
If you don’t agree with any part of them, you’re not allowed to use the service.

3.     Age Requirements

o   You confirm that you are at least 18 years old.

o   However, people under 18 are not allowed to use this service at all—even if they are over 16. (This is a stricter rule by the company.)

4.     Privacy Policy is Also Part of the Agreement
Using the service also means you agree to the Privacy Policy, which explains:

o   What personal information the app stores by company directly or indirectly(like name, email, or location)

o   How that information is used and protected

o   Your rights regarding your data

You are expected to read the Privacy Policy carefully before using the service, as it's an important part of how the company interacts with your data.

Links to Other Websites

This section is about what happens when your app or website links to other websites or services that aren’t owned by your company.

Here’s what it means:

1.     You Might See External Links in the App or Website
Sometimes, the service may include links to other websites or services (like YouTube, Instagram, payment gateways, news articles, etc.) that are not owned or managed by hoocup.fun.

2.     The Company Is Not Responsible for Those Other Sites

o   hoocup.fun does not control these third-party websites.

o   The company is not responsible for their content, how they use your data, or how their services work.

o   The company holds no responsibility for any issues arising from third-party     websites, including misuse of information, fraudulent activities, or inappropriate content. Any consequences or losses you experience from using those external sites are entirely your own responsibility.

3.     You Use External Sites at Your Own Risk
By clicking on or using a link, you accept the risk involved with visiting that site. It’s your responsibility to make sure the site is safe and trustworthy.

4.     Always Read Their Terms and Privacy Policy
Before using any linked third-party site, you should read their Terms and Conditions and Privacy Policy, because those rules will apply while you are on their site — not the rules of hoocup.fun.

Termination

This part explains how and when the company can end or suspend your access to the app or service.

Here’s what it means:

1.     Your Access Can Be Stopped at Any Time
The company (hoocup.fun) has the right to suspend or permanently block your access to the service immediately and without warning.

2.     You Don't Have to Be Notified First
They can do this without giving you any prior notice or explanation — especially if you break any of the rules written in the Terms and Conditions.

3.     Examples of Rule Violations
Though not listed in this section, some common reasons your access could be terminated include:

o   Misusing the service

o   Sharing harmful or illegal content

o   Violating others’ rights

o   Attempting to hack, spam, or exploit the platform

4.     Immediate Effect
Once your access is terminated, you can no longer use the app or service — all your rights to access or interact with it end right away.

Limitation of Liability

This section sets boundaries on how much responsibility the company has if something goes wrong while you're using the service.

1. Company Is Not Responsible for Indirect Damages

To the fullest extent allowed by law, the company and its partners won’t be held responsible for things like:

·        Lost profits

·        Lost data

·        Personal injury

·        Business losses

·        Loss of privacy

·        Any problems caused by third-party software, hardware used with the service or any loss caused to you related or non related to our software
Even if the company knew these things might happen, they are not liable.

2. Why This Exists

This is a standard legal protection to prevent users from suing the company for huge amounts of money over things that are:

·        Out of their control

·        Not directly caused by them

·        Covered by third parties (like Google, Apple, etc.)

3. Some Places Have Different Rules

·        In some places (like certain U.S. states or countries), these kinds of legal limitations are not fully allowed.

·        In those areas, the company’s liability will still be limited — just to the maximum level allowed by local law.

"AS IS" and "AS AVAILABLE" Disclaimer

This section is a legal disclaimer that tells users what not to expect from the company or the service. It protects the company by clarifying that the service comes with no guarantees or promises.

1. Service Comes “As Is”

·        The app or service is provided to you exactly as it is right now, with all its flaws or issues.

·        The company is not promising that it’s perfect or that it will work exactly the way you want or expect.

2. No Warranties – Express or Implied

·        The company refuses all types of warranties, including:

o   That it will work for your specific purpose

o   That it’s merchant-quality or professional-grade

o   That it’s free from copyright issues or bugs

o   That it will keep working well in the future

·        This also includes any assumptions people might make based on industry standards, user experience, or other products.

3. No Guarantee of Performance

·        The company does not promise that:

o   The app will always work without crashes or errors

o   It will work on your device or with other apps

o   The service will meet your goals or expectations

o   Any errors or problems will be fixed

4. No Responsibility for Harmful Components

·        The company also doesn’t promise the service is free from viruses, malware, or other harmful elements.

·        If your device gets damaged from using the service, the company is not liable.

5. Some Places Have Different Rules

·        In some countries or states, these disclaimers might not be fully allowed under law.

·        If that's the case for you, the disclaimer will still apply as much as the law allows in your area.

Governing Law

This section explains which country’s laws will apply if there’s any legal issue or disagreement about the service or the Terms.

1. Local Laws Will Apply

·        The rules and regulations of the mentioned country (in your case, likely India) will govern:

o   These Terms and Conditions

o   How the service is used

o   How any disputes or legal matters are handled

2. Excludes Conflict of Law Rules

·        It says that only the main laws of the country apply — not any rules that try to pull in laws from another country or state (called "conflict of law" rules).

3. Other Laws May Also Apply

·        Depending on where you live or use the app, other regional, state, or international laws may also apply to you.

o   Example: A user in the EU might also be protected by EU privacy laws like GDPR.

Disputes Resolution

This section outlines what to do if you have a problem or conflict with the company related to the app or service.

1. Try to Solve Problems Informally First

·        If you have any concern, complaint, or disagreement (such as a refund issue, technical failure, or privacy concern),
— You agree to contact the company first before taking legal action.

·        The goal is to try and resolve the issue peacefully through communication, rather than jumping straight into a legal case or formal complaint.

·        In any case the company is not responsible for any issue caused to customer with or without means of company.

2. What "Informally" Means

·        This means contacting the company through:

o   Email

o   In-app support

·        You and the company will discuss the issue and attempt to fix it without lawyers or courts at first.

United States Legal Compliance

This part is about following certain U.S. government rules, especially when it comes to international use of the app or service.

1. You Confirm You're Not in a Restricted Country

·        You are not allowed to use the app if:

o   You are in a country that the United States has placed under embargo (a ban on trade or technology).

o   You are in a country the U.S. considers a “terrorist-supporting” nation.

2. You Confirm You’re Not on a U.S. Sanctions List

·        You also confirm that you are not personally:

o   On any official U.S. government list of individuals or organizations that are banned from doing business with U.S. companies.

3. Why This Matters

·        Even if the company is based outside the U.S., many digital services (especially apps on Apple App Store or Google Play) must comply with U.S. export control laws.

·        If someone from a restricted country tries to use the app, the company could face legal trouble, so this clause protects them.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
